VICTORIES, WINS, RESULTS, AND SUCCESS STORIES:

$8,250,000 (Jury Trial Verdict) -- Breast augmentation and mastopexy malpractice case. The bulk of the jury verdict was for pain & suffering. Our client had 13 surgeries to repair the damage following the original surgery and was left with significant permanent damage.

$8,000,000 (Litigation Pre-Trial Settlement) -- Our client was rear-ended by a garbage truck, suffering a broken neck. The case was vigorously defended but ultimately settled prior to trial.

$6,400,000 (Jury Trial Verdict) -- Failure to diagnose cancer case. Our client kept going back to ENT for treatment and was complaining that he wasn’t getting better. He finally sought a second opinion, but it was too late, and he lost his tongue and has a permanent feeding tube.

$3,830,000 (Jury Trial Verdict) -- Our client was a motorcyclist who was hit and ejected from his motorcycle by a large sedan that failed to yield right of way to oncoming traffic when turning left. He sustained multiple bone fractures, road rash, and had hardware surgically implanted in his leg to regain the ability to walk and work.

$2,250,000 (Wrongful Death Settlement) -- Plastic surgery case where a patient was not being monitored properly, was over anesthetized during surgery, and passed away.

$2,050,000 (Wrongful Death Settlement) -- Client who went in for the purpose of surgically removing a benign tumor. Ultimately, his vital signs deteriorated, and he became unresponsive and passed away.

$1,750,000 (Jury Trial Verdict) -- Jury Verdict in defective construction case with catastrophic injuries to our client.

$1,710,000 (Settlement) -- Our client presented with shortness of breath. A pulmonary function test was done and exhibited abnormal findings. The doctor noted upper airway obstruction, but nothing was done. Delay in diagnosis necessitated a total laryngectomy with severe resulting injuries to our client, including an almost complete loss of speech and a permanent hole in his throat requiring constant maintenance and medical care.

$1,500,000 (Settlement) -- In this most unfortunate case, our client was correctly diagnosed with an acute above the knee DVT (deep vein thrombosis) and, contrary to multiple nationally accepted standards of practice, the client failed to get immediate anticoagulation and 12 hours later developed massive pulmonary emboli, causing a major stroke that left him wheelchair-bound, legally blind, mentally impaired and unable to take care of even his most basic needs, requiring 24-hour care for the rest of his life.

$1,389,000 (Settlement) -- Our client was bitten by a spider while in a housing facility, and then refused appropriate, necessary, and time-sensitive medical care. As a result, he became partially paralyzed.

$1,330,000 (Settlement) -- Our client was electrocuted and horribly injured while working as an electrical lineman.

$1,200,000 (Settlement) -- Settlement reached on behalf of our client who was catastrophically injured in a motorcycle crash.

$800,000 (Settlement) -- Our client was hit by a commercial vehicle that illegally merged into our client’s lane of travel while on interstate 75, the impact pushed our client’s vehicle into a guardrail on the side of the interstate totaling his vehicle. Our client underwent extensive therapy and had multiple surgeries to repair injuries to their neck and back.

$750,000 (Wrongful Death Settlement) -- Settlement reached on behalf of surviving children who lost their mother following a fatal car accident.

$600,000 (Settlement) -- Recovery for a cyclist riding in her private home community was hit by another resident who did not see our client and ran into her, cracking the driver’s windshield with her head. Our client suffered a skull fracture and hematoma, putting her in the Trauma Center ICU for 10 days.

$600,000 (Settlement) -- Recovery for a widow who lost her husband in an terrible automobile wreck.

$510,000 (Policy Limit Tender / Settlement) -- Policy limit settlement reached on behalf of a client who was permanently injured in a fatal head-on car accident, with her life spared. The underinsured and at-fault driver only carried $10,000 in bodily injury coverage. Thankfully, our client carried underinsured/uninsured motorist coverage, which paid out policy limits of $500,000. Our client suffered 70% degloving of her left foot and underwent multiple surgeries and procedures with extreme wound care.

$500,000 (Policy Limit Tenders / Settlements) -- Settlement on behalf of a part-time Lee County resident who was hit by an automobile while crossing the street on his bicycle. This crash left him permanently blind at a time when he and his wife had retired and were planning to move to Florida permanently to live out their golden years in southwest Florida. Unfortunately, our client was cited for causing this crash. However, after we began the investigation, we successfully persuaded both insurance companies that the other driver was largely responsible for our clients’ horrific damages. Both insurance companies ultimately settled for their entire policy limits.

$500,000 (Settlement) -- Settlement reached on behalf of a widow who lost her husband due to medical malpractice of a cardiologist.

$500,000 (Litigation Settlement) -- Insurance Bad Faith case, where the underlying Defendant’s insurance company failed to settle with the underlying Plaintiff when they could have and should have. The client’s Insurance Company refused to settle the Tort case, which then went to trial resulting in a $300,000 excess verdict against the client as the result of bad faith claims handling.

$500,000 (Settlement) -- Result obtained for our client who had knee replacement surgery, got an infection that went negligently treated which caused the leg to have to be amputated.

$499,500 (Settlement) -- Settlement reached on behalf of a widower who lost his wife when their RV “slide” malfunctioned, causing her to be crushed to death.

$495,000 (Litigation Pre-Trial Settlement) -- Suit initiated against homeowners, homeowners’ association (HOA), and a landscaping company. Client sustained severe injuries to her head and neck including a traumatic brain injury “TBI” and required multiple surgical procedures on her neck, when a 70-pound palm frond from a negligently maintained palm tree fell over 70 feet and hit the client in the head and neck. The case was defended vigorously but ultimately the matter was settled before trial.

$450,000 (Settlement) -- Settlement reached for a client who was out walking her dog in Fort Myers Beach, Florida when a vehicle failed to yield and hit her and her dog. Our client ended up on the hood while her dog ended up under the vehicle that struck them. She sustained a spinal fracture and after unsuccessful conservative treatments, had to undergo surgery for her injuries.

$450,000 (Settlement) -- Settlement reached on behalf of an elderly our client who was walking on a sidewalk in her neighborhood and struck by a neighbor backing out of her driveway, suffering traumatic injuries

$425,000 (Litigation Settlement) -- Suit initiated for a handicapped client who fell and broke his femur on a negligently maintained ramp to a local business. Our client fell and broke his femur and also injured his lower back. Our client underwent surgery where hardware was implanted to repair his femur and then also injections to his lower back along with pain management. The case was defended vigorously until a scene inspection was done with experts. Shortly after the scene inspection and a properly timed proposal for settlement the case settled.

$410,000 (Pre-Suit Settlement) -- Recovery made for a client who was rear-ended by a young driver with a history of careless driving, who was negligently entrusted with a 500-horsepower sports car by her father and was grossly underinsured. The crash totaled both vehicles involved, and the client sustained multiple injuries to her head, neck, and back that required multiple surgical procedures, including a disc replacement.

$400,000 (Litigation Pre-Trial Settlement) -- Suit brought for our client who suffered a concussion, mental impairment, separated shoulder, and dislocated jaw after slipping on the slick tile around a water fountain at a shopping center. The suit was vigorously defended, and a settlement ultimately reached before trial.

$400,000 (Settlement) -- Recovery made for our clients who were making their commute down for the season when they were struck from behind by a driver who failed to slow with traffic. The couple was forced to stay in a hospital in the Carolinas for 12 days to recover from their traumatic injuries.

$400,000 (Settlement) -- Settlement reached for surviving adult children when their mother, who resided in a nursing home, was unsupervised, obtained access to locked door codes and fell down a set of stairs, suffering fatal injuries.

$400,000 (Settlement) -- Settlement on behalf of an elderly Lee County couple carelessly struck by a young driver and who suffered serious injuries which separated them from each other for months while each received rehabilitation from their injuries and subsequent surgery. The crash changed their lives forever by taking away their quality of life during their retirement years.

$389,000.00 (Settlement) -- Residential house/home fire that destroyed an entire house with severe bodily injuries to the homeowner who was in a coma for months. After many months of therapy and multiple surgeries the client made a very good recovery under the circumstances of this incident.

$377,500 (Settlement) -- Settlement on behalf of a Miami-Dade County woman who tripped and fell down the stairs at a furniture store. She underwent four (4) separate surgeries to repair the permanent damage caused by the fall.

$375,000 (Pre-Suit Settlement) -- Young girl was injured on a recreational boating apparatus due to the negligent and reckless operation of it by the company’s employee/agent. Client sustained a fracture to her femur that required surgical intervention with the placement of hardware and lengthy and painful post-operative rehabilitation.

$363,000 (Litigation Arbitration) -- Arbitration award for our client who was hit and injured while riding her bike along the sidewalk in front of a convenience store. Her injuries included a total left knee arthroplasty, left shoulder surgery, surgical release of entrapped nerves in her left leg, and multiple injections to the knee and shoulder. The suit was vigorously defended, as from the beginning the at-fault driver placed the guilt on our client, contending that she drove her bike into his truck and then “threw herself upon his windshield”.

$350,000 (Policy Limit Tender / Settlement) -- Client was hit by a commercial vehicle whose driver was on their cell phone. The client was rushed to the emergency room via ambulance for emergency surgery, but unfortunately died from the injuries he sustained by the distracted driver. This case serves as a reminder to put down your cell phone when driving or operating a vehicle or heavy machinery.

$350,000 (Settlement) -- A distracted and careless driver caused a 4-car pileup accident in Fort Myers, Florida. Our client was sandwiched between vehicles and sustained an exacerbated knee injury as well as neck and low back pain, which led to numbness in her arms and fingers.

$350,000 (Litigation Settlement) -- Suit brought on behalf of a parent who lost her child as a result of a drug overdose given at the unsupervised home of a friend whose parents were aware of the drug problem and did nothing about it.

$350,000 (Litigation Settlement) -- Suit was brought against a radiologist who misread an abdominal X-Ray and failed to detect a clot in the artery that serves the colon resulting in the death of a major portion of the colon, a permanent colostomy, and long-time suffering.

$350,000 (Litigation Settlement) -- Settlement reached at mediation on behalf of our client who lost half of her teeth, suffered numerous infections, and was hospitalized several times due to substandard dental work.

$325,000 (Settlement) -- Settlement obtained for our client involved in an automobile accident when an elderly gentleman just “stopped” his vehicle in the southbound lane of I-75. Her left ankle was crushed, and X-Rays revealed both comminuted (broken into small pieces) fractures and simple fractures in her left foot and a fracture of the shaft of the proximal phalanx of the second toe on her right foot.

$316,000 (Settlement) -- Settlement on behalf of a Lee County woman who was struck by and then run over and dragged by a golf cart, causing her death. This case involved various policy defenses and issues as most golf carts are not covered by automotive insurance coverage and exempted from homeowner’s insurance coverages as well.

$300,000 (Policy Limits Tender / Settlement) -- Settlement reached on behalf of our client who was hit with such force while riding his motorcycle. He sustained numerous injuries, including permanent brain damage. The case resolved for all available insurance.

$285,000 (Litigation Settlement) -- Suit initiated for a client who was hit by a vehicle that failed to yield the right-of-way to oncoming traffic while at a stop sign. The at-fault driver hit our client’s vehicle in a T-Bone type impact. The client sustained injuries to his neck, shoulder, and low back. The client required injections to all injured areas and ultimately required a surgical repair of a herniated disc in his neck.

$282,000 (Settlement) -- Client was hit by a vehicle that ran a red light after getting off of interstate 75. This highway speed wreck caused disabling damage to both vehicles and the client was rushed to the emergency room by ambulance and had emergency surgery on his arm to fix multiple fractures and implant hardware. Client then underwent many months of therapy in order to regain control, range of motion, and strength.

$280,000 (Settlement) -- Client was rear-ended by a tractor-trailer while in the course and scope of work as an A/C Repair Technician. He was hospitalized, suffered a Traumatic Brain Injury (“TBI”), and also required surgery on his shoulder due to the speed of the impact from the tractor-trailer.

$254,000.00 (Litigation Pre-Trial Settlement) -- Client was hit by a pizza delivery driver who ran a red light, which resulted in broken bones and herniations to the vertebrae of the client’s spine. The client had over 18 months of treatment, stem cell injections, a surgery on his hip, and was recommended a partial hip replacement.

$250,000 (Settlement) -- Settlement on behalf of a Missouri woman vacationing with her husband in Key West. Her trip was ruined, and her life severely altered by a fall on a poorly constructed hotel doorway, this crooked and unmarked step led into her hotel room. The fall happened shortly after she arrived at the room, and we were able to show multiple code violations as well as an obvious defect that hid this dangerous condition from the hotel guests.

$250,000 (Settlement) -- Settlement on behalf of a Collier County widow who was forced to undergo total knee replacement when she was struck by a vehicle while riding her bike.

$240,000 (Settlement) -- Settlement reached on behalf of our client who was rear-ended with such force that his headrest was knocked out of its holder and his steering wheel bent. He suffered numerous injuries to his back, neck, and leg. He ultimately required surgery.

$200,000 (Settlement) -- Recovery on behalf of a cyclist, who had the right-of-way when she was hit by a vehicle making a right turn which caused her to fall from the bike. She suffered a concussion, broken collarbone, and damage to her elbow and rotator cuff and ultimately underwent surgery.

$200,000 (Policy Limits Tenders / Settlements) -- Policy limits recoveries made on behalf of a client who was injured when another vehicle attempted to make a left hand turn across oncoming traffic and collided with the front of our client’s vehicle causing disabling damage to both. Client was transported to the hospital by ambulance and sustained injuries to his head and neck, which both required surgical procedures and lengthy therapy.

$198,750 (Settlement) -- A cyclist couple was riding along in Sanibel, Florida vacationing when our client was hit, walking her bike along the crosswalk of an intersection. Upon arrival at the hospital, our client suffered hip, knee, and shoulder pain which ended up consisting of a tibial fracture, rotator cuff tear, and sprains which left her unable to care for her husband who recently underwent prostate cancer surgery following their trip.

$190,000 (Settlement) -- Settlement reached on behalf of a client who was rear-ended while stopped in traffic at a red light. Both vehicles sustained heavy damage from the impact and the client sustained injuries to their head, neck, and low back. Client underwent treatment for about a year, culminating with a surgical procedure to fix two herniated discs in her neck.

$185,750 (Settlement) -- Recovery on behalf of a client who had a vehicle attempt to make a left hand turn while she was going straight and hit her head on, resulting in injuries to her arms, legs, and neck which required lengthy treatment, injections, and surgery.

$175,000 (Settlement) -- Our client was out golfing when his friend was hit by a golf cart. The friend was hit so hard, he was forced into our client who broke his friend’s fall and our client landed several feet away, unable to get up. He sustained a fracture which put him in a wheelchair in addition to shoulder tears. Diagnostic testing revealed our client also reinjured his previous hip replacement and needed revision surgery immediately.

$172,500 (Settlement) -- Settlement reached on behalf of our client who was rear-ended while sitting at a red light. She suffered immediate pain in her neck, back, and right shoulder, along with right knee pain and swelling. She ultimately underwent right shoulder surgery.

$160,000 (Litigation Settlement) -- Client was hit by a large delivery vehicle that failed to yield the right-of-way. The client sustained injuries to his neck and back which required over a year of treatment, including injections, and surgery.

$156,522 (Settlement) -- Settlement on behalf of a young Miami-Dade County woman who suffered serious and permanent injuries when she was rear-ended while stopped in traffic. At the time, she was to graduate from chef school and about to embark on her dream of being a chef.

$150,000 (Policy Limits Tender / Settlement) -- Client was rear-ended by another vehicle because the driver was distracted and on their cell phone. The client sustained injuries to his shoulder, neck, and back. Client’s injuries were treated for almost a year, which included PT, OT, Chiropractic care, injections, and ultimately surgery.

$150,000 (Settlement) -- Settlement reached on behalf of our client who suffered the loss of just about all of her teeth when a dentist violated the biologic width during crown procedures. She underwent numerous corrective procedures.

$150,000 (Policy Limits Tender / Settlement) -- Client was side-swiped by a vehicle that was speeding and improperly passing, which put the client’s vehicle into a spin that then crashed into a ditch on the side of the road. Client sustained injuries to their neck and back which ultimately required surgical intervention to fix.

$150,000 (Settlement) -- Recovery made for a client who had just received a chemo treatment, while attempting to return to her caregiver’s car who was parked several spots down from the handicap, our client fell from the curb and fractured her wrist as well as broke/lost teeth.

$150,000 (Litigation Settlement) -- Client was hit by a vehicle whose driver ran a red light and collided with our client’s vehicle in a “T-Bone” type impact. The client sustained injuries to their neck, back, and shoulder. Client underwent therapy for over a year including physical therapy, ultrasound therapy, injections, and pain management. The client also was recommend to undergo a surgical intervention to repair her badly damaged shoulder.

$135,000 (Settlement) -- Settlement reached on behalf of a client who was riding a bicycle in the proper bicycle lane when an elderly woman, who was later deemed in an altered mental state, crossed the shoulder’s line, hit our client, and fled the scene; leaving him with a serious permanent injury.

$130,000.00 (Pre-Suit Settlement) -- Client was struck by another vehicle in a “T-Bone” type impact that resulted in a tear of her rotator cuff which required surgical intervention and then lengthy and painful post-operative therapy.

$120,000 (Policy Limits Tenders / Settlements) -- Client was hit by a driver who was drunk and sustained injuries to their neck and back which required over a year of medical treatment including injections and surgical intervention. Both the at-fault driver’s insurance company and the client’s insurance company paid every penny of coverage available for the claim after intense negotiations.

$120,000 (Policy Limits Tenders / Settlements) -- Client was hit by a driver who was drunk and sustained injuries to their brain and neck, including being diagnosed with a Traumatic Brain Injury (“TBI”). $115,000 (Litigation Settlement) -- Client was injured on a poorly maintained sidewalk of a private health care facility, sustaining injuries to her knees, hips, and low back, which required surgical repair. The area where the client was injured ended up being repaired shortly after our office notified them of our representation. The case was defended vigorously, but ultimately settled before trial.

$100,000 (Policy Limits Tender / Settlement) -- Policy limit recovery made for a client who was riding her bicycle in Sanibel, Florida when a driver made a right-hand turn into her right-of-way path, causing her to strike the vehicle’s passenger door. Injuries sustained include a fracture of the spine. There was also a significant wage loss claim and consortium claim for her husband who took time off to care for his wife.

$100,000 (Policy Limits Tender / Settlement) -- Policy limit recovery made for a client who was on his motorcycle and was hit at highway speeds. Our client was emergently transported to the hospital via ambulance with broken bones that were surgically repaired. Even though the client was wearing a helmet his still sustained a traumatic brain injury “TBI”.

$100,000 (Policy Limits Tender / Settlement) -- Policy limit recovery made for a client who was riding her bicycle attempting to cross in the crosswalk and was struck by a big truck driver who did not see her. Our client was thrown to the ground and hit her head on the street. She suffered a tibial and fibula fracture which led to surgery on her knee.

$100,000 (Settlement) -- Our client was in an automobile crash as a result of an oncoming vehicle making a swift left turn in front of him as he was driving through an intersection. Airbags in both vehicles deployed and our client’s car was totaled. He suffered a fracture of the body of sternum with chest, neck, wrist, and back pain. Ultimately, our client underwent surgery on his wrist and continued numbness/tingling in his fingers.

$100,000 (Policy Limits Tender / Settlement) -- Client was hit by a vehicle that did not see them due to a damaged side mirror. Client was taken to the hospital by EMS and sustained a broken neck.

$100,000 (Policy Limits Tender / Settlement) -- Client was hit while crossing the street at a crosswalk by a distracted driver. They were taken to the hospital by EMS and was diagnosed with a Traumatic Brain Injury (“TBI”).
