Florida car accident lawsuit

Florida seatbelt laws require all motor vehicle drivers and passengers to wear a seat belt to lower the risk of serious injury and death caused by car accidents. Failure to do so could result in a ticket, but worse, it could be the difference between minor and life-altering injuries. For this reason, courts have held that Florida car accident lawsuit plaintiffs could have their damages reduced if they were not wearing a seat belt at the time of the crash. car accident lawyerWe are often asked: “Can you get pulled over for not wearing a seatbelt” or “how much is a ticket for not wearing a seatbelt”- Until recently, our Florida seat belt laws stated that drivers in Florida could only be cited for not wearing seat belts if they were pulled over for something else, such as speeding.

That changed in 2009 with the passage of the Dori Slosberg and Katie Marchetti Safety Belt Law. With the passage of this Florida seat belt law a driver who is not wearing a seat belt can be pulled over and issued a traffic citation for a nonmoving violation.

The state fine for a seatbelt violation will be $35, and each county may impose additional fines and court fees as well. Drivers and passengers who are found in violation of the new law are subject to a $114 fine in Miami-Dade County and $115 fine in Broward County.
